Welcome to Chatbotics (“we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Chatbotics website, platform, dashboard, APIs, and all related services (collectively, the “Service”). By creating an account, using the platform, or accessing any part of our Service, you agree to be bound by these Terms.
If you do not agree with these Terms, you may not use Chatbotics.
Using the Service
1. Eligibility
You must:
- Be at least 18 years old
- Have the legal authority to enter into a binding agreement
- Use the Service in compliance with all applicable laws
2. Account Registration
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Ensuring your account details remain accurate
- All actions taken under your account
We may suspend or terminate accounts that violate these Terms.
3. Customer Data & End-Users
When using Chatbotics, you may process personal data belonging to your end-users (e.g., WhatsApp, Instagram, Messenger, website visitors).
You acknowledge that:
- You are the Data Controller for your end-user data
- Chatbotics acts solely as a Data Processor
- You are responsible for providing necessary notices and obtaining required consents
4. AI Output & Limitations
Chatbotics generates AI-driven responses.
You acknowledge that:
- AI-generated content may contain errors or inaccuracies
- You are responsible for reviewing outputs before relying on them
- You must not use AI-generated content in ways that violate laws or harm users
Subscriptions, Billing & Payments
1. Plans
Chatbotics offers multiple subscription levels: Free, Basic, Pro, and Enterprise.
Features vary by plan.
2. Billing
- Paid plans renew automatically unless cancelled
- Fees are billed in advance
- Taxes may apply depending on your jurisdiction
3. Cancellation & Refunds
- You may cancel at any time through the dashboard
- Refunds are generally not issued for partially used billing periods
- Access continues until the end of the paid term
4. Free Plan Limitations
We may restrict features, usage, or access on the Free plan at our discretion.
Acceptable Use
You agree not to use Chatbotics to:
- Violate any law or regulation
- Send spam or unsolicited messages
- Harass, deceive, or harm others
- Upload malicious software, code, or viruses
- Misuse integrations (WhatsApp, Instagram, Messenger, Telegram, Shopify, etc.)
- Interfere with or disrupt the Service
- Attempt to reverse-engineer any part of the platform
Violations may result in immediate suspension or termination.
Integrations & Third-Party Services
Chatbotics allows you to connect external messaging platforms and applications (e.g., Meta Channels, Shopify, websites).
You acknowledge that:
- Third-party services are governed by their own terms
- We are not responsible for failures or outages of third-party platforms
- You are solely responsible for maintaining your external platform accounts and compliance
If a third-party provider suspends or restricts your account, Chatbotics is not liable for resulting disruptions.
Human Agent Intervention
Chatbotics includes optional features allowing human agents from your team to step into conversations when required.
You are responsible for:
- Managing your own agents
- Ensuring compliance with privacy laws
- Monitoring interactions between your agents and your end-users
Data Security & Privacy
We implement industry-leading security measures, including:
- HTTPS/TLS encryption
- Encrypted data-at-rest
- Strict internal access controls
- Regular security monitoring and auditing
Your use of Chatbotics is also governed by our Privacy Policy, which explains how data is collected and processed.
Intellectual Property
Chatbotics owns all rights to:
- The platform
- User interface
- Documentation
- Software
- AI features
- Branding, logos, and trademarks
You retain ownership of:
- Your content
- Your customer data
- Your chatbot designs and configurations
Using Chatbotics does not grant you ownership of our intellectual property.
Termination
We may suspend or terminate your access to the Service if:
- You violate these Terms
- Your payment fails
- You misuse integrations or violate third-party policies
- We receive legal instruction to disable your account
Upon termination:
- Your access to the platform ends immediately
- We may delete your data according to our Privacy Policy and legal obligations
You may terminate your account at any time through the dashboard.
Warranty Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
We do not guarantee that:
- The Service will be uninterrupted or error-free
- AI outputs will be accurate
- Integrations will function continuously
- Third-party platforms will not experience outages
You use Chatbotics at your own risk.
Limitation of Liability
To the maximum extent permitted by law:
- Chatbotics shall not be liable for indirect, incidental, punitive, or consequential damages
- Chatbotics is not responsible for losses caused by third-party integrations or platform outages
- Chatbotics’ total liability arising from any claim shall not exceed the amount paid by you during the 12 months preceding the claim
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold Chatbotics harmless from claims, damages, liabilities, and expenses arising from:
- Your misuse of the Service
- Your violation of these Terms
- Your end-users’ actions
- Your use of third-party messaging platforms and APIs
General
Governing Law
These Terms are governed by the laws of the jurisdiction in which Chatbotics is legally registered, without regard to conflict of law principles.
Changes to Terms
We may update these Terms periodically.
Material changes will be posted on this page with a revised “Last Updated” date.
Severability
If any part of these Terms is deemed invalid, the remainder remains in full effect.
